Peru is 100% smoke-free indoors, and the law's definition of "indoors" is wider than most travellers expect. Article 6.1 of Law 32159 bans smoking (and vaping) in health and education establishments, public offices, workplaces, enclosed public spaces and any means of public transport. Article 6.2 defines an enclosed public space as any place of public access that has a roof and two or more walls, whatever the material, size or height, and whether it is permanent or temporary - so a covered restaurant terrace with two walls is inside the ban. Every such place must display the notice "ESTA PROHIBIDO FUMAR Y VAPEAR EN ESTE ESTABLECIMIENTO..." (art. 7). Law 32159, published 12 November 2024, repealed the older Law 28705 and Law 29517, so advice citing those is out of date.
Law 32159 states no fine amount of its own. Enforcement of tobacco and nicotine use and sale is assigned to the provincial and district municipalities and to the Ministry of Health within their competences (art. 17.2), with Minsa, local government and INDECOPI acting on compliance generally (art. 17.1); the Fourth Complementary Provision leaves the operating detail to a supreme-decree regulation. The amount a smoker is charged therefore comes from municipal enforcement rules, not from this statute.
