Cannabis is illegal in Hungary. Consuming it, or acquiring or keeping a small quantity in order to consume it, is a misdemeanour carrying up to two years in prison (Criminal Code s. 178(6)); any other acquiring, keeping, growing, importing, exporting or ordering from abroad for delivery into Hungary is a felony carrying two to eight years (s. 178(1)). "Small quantity" is defined by potency, not by plant weight: up to 6 grams of total THC, or up to five cannabis plants (s. 461). The treatment route that avoids punishment (s. 180) now requires you to confess, to prove six months of continuous treatment by document, and to reveal who sold you the drug, and it is closed to anyone who has already used it twice.

Consumption, or a small quantity held for consumption: up to 2 years' imprisonment (s. 178(6)). Other possession, cultivation or importation: 2 to 8 years (s. 178(1)). Substantial quantity: 5 to 15 years; particularly substantial quantity: 5 to 20 years (s. 178(2)). Substantial means more than twenty times the small-quantity ceiling, particularly substantial more than two hundred times it (s. 461(3)).

Do not count on buying vape liquid in Hungary: by Hungarian law an e-cigarette or refill container may be placed on the market only with no flavour at all, and a nicotine-free refill or smoking-imitation device must be both nicotine-free and flavourless. That is a national rule, stricter than the EU baseline - Hungary's own public-health authority tells manufacturers not even to file a notification for a flavoured product. Selling an e-cigarette packaged together with refill bottles or cartridges (a "kit-pack") is prohibited outright, and these products may be sold only in compliance with Hungary's tobacco retail Act, not in ordinary shops. Bring the liquid you need, and expect the shelves to carry unflavoured stock or none.

Government Decree 39/2013 (II. 14) Section 19/B (1): electronic cigarettes and refill containers may be placed on the market only without any flavour. Section 19/C (1): electronic devices imitating smoking and nicotine-free refill containers may be placed on the market and distributed only if the liquid inside contains no nicotine and no flavouring. Act CXXXIV of 2012 on the Reduction of Underage Smoking and the Retail Sale of Tobacco Products, Section 15/D (10): sale of kit-packs - an electronic cigarette packaged together with refill bottles or cartridges - is prohibited in Hungary, as is selling any of the listed products together with another listed product or by lottery or similar consumption-encouraging means. Section 1 (1) of the same Act lists electronic cigarettes, refill bottles, cartridges, nicotine-free refill containers and smoking-imitation devices among the products that may be dealt in only in compliance with that Act. You cannot buy a Hungarian prepaid SIM anonymously: the shop must verify your identity document against the national register before the contract exists. Section 129(2) of the Electronic Communications Act (2003. évi C. törvény az elektronikus hírközlésről, "Eht.") requires the provider, before concluding a contract for prepaid mobile radiotelephone service, to check the validity of the subscriber's official identity document in the national register of identity documents -- for a business subscriber, the document of the person signing. Section 129(2a) is explicit about the consequence: without a successful identity check the subscriber contract cannot be concluded and the provider may not begin supplying the service, so a passport that cannot be validated means no SIM rather than a penalty. Section 129(2c) allows the identity check for prepaid mobile to be initiated or completed through online registration instead of in person. Where a chain of fixed-term contracts runs beyond one year, the provider must re-verify the subscriber's data after the first year and then annually (§ 129(2b)). A third party may hand you a SIM only if they gave the provider the data needed for the § 129(2) check beforehand and the provider validated that third party's identity document; a close relative does not count as a third party for this rule (§ 127(2b)).

The Act states a service consequence rather than a penalty on the traveller: where the identity check under § 129(2) is not successfully completed, the subscriber contract cannot be concluded and the provider may not start supplying the service (Eht. § 129(2a)). A provider may also terminate a prepaid mobile subscriber contract on five days' notice where the subscriber handed the SIM card on before it was given over without the § 129(2) data having been supplied, and where an identity document is found to be invalid on a § 129(2b) re-check the same termination route applies. No fine on the user is stated in these sections; the supervisory consequences for providers sit elsewhere in the Act and were not read for this entry.
